Start Your Trucking Business
You’re ready to start a trucking business. But where do you actually begin?
Most new owner-operators conflate two completely separate phases: Start (forming the business, opening a bank account, getting state permission to exist) and Authority (applying to the FMCSA for a USDOT number, MC number, and insurance). This page covers Start. Authority comes next.
The real order of operations
Here’s what you must do, in this exact order:
- Choose and form a business structure — sole proprietorship or LLC (more on that below)
- Get an EIN — your business tax ID
- Open a business bank account — using your EIN
- Obtain a general state business license — varies by state
- Then move to Authority — USDOT number, MC number, BOC-3, insurance, UCR
Why this order? Because the IRS, your bank, and your state don’t care about FMCSA rules. FMCSA doesn’t care what business entity type you are. But your bank will not open an account without an EIN, your state requires a business license to legally operate, and you cannot insure yourself or hire broker loads until you have an MC number (which comes in the Authority phase).
Why this matters: liability and paperwork
The first question—business structure—matters more than it appears. It determines whether you’re personally liable if your business is sued or owes money to a factoring company or broker.
- Sole proprietorship: Zero cost to start, but your personal home and bank account are on the line if the business fails or is sued.
- LLC (Limited Liability Company): Costs $50–$500 to form (depends on your state), but it separates your personal assets from business liability—the reason most small carriers form one.
After you decide, the path is mechanical: get the number from the IRS (EIN), prove it to your bank, file paperwork with your state, and keep those accounts separate. Commingling your business money with personal money doesn’t just make bookkeeping messy—it can undermine the liability protection an LLC is supposed to give you.
What comes next
Once you’ve formed the business and opened a bank account, you’re ready for the Authority phase: applying for your USDOT number, MC number, and initial insurance. That’s a different set of paperwork and costs.
